Abigail Nitka

Abby is the Lead Partner of the firm’s New York office. She opened the New York office of Messner Reeves in 2013 after practicing for almost 10 years at a national law firm specializing in insurance matters. She has extensive experience litigating in state and federal courts in New York and New Jersey.

Abby’s diverse practice is primarily defense-oriented, and includes Insurance Coverage, Labor & Employment, General Liability, food-borne illness, and complex Marine and Energy matters. She focuses on advising clients on insurance coverage matters, and has represented both carriers and policy holders. Recently, Abby obtained a highly favorable outcome in a case involving class-wide antitrust and RICO claims levied against her clients, who are members of the London-based insurance market.

Her litigation experience includes successful defense of class action wage and hour cases, and she has obtained defense verdicts in discrimination lawsuits alleging retaliatory discharge, harassment, and wrongful termination.

Abby also advises employers and businesses on American with Disabilities Act compliance. She uses a hands-on, collaborative approach with facilities teams, architects and construction managers to ensure ADA compliance of physical facilities. She has also worked with website developers and technology departments to ensure ADA compliance of websites and apps.

Abby serves as chair of the Regulatory Affairs Committee of the New York City Bar Association Restaurant and Hospitality section. She also provides pro-bono legal services to unaccompanied minors in immigration court through the non-profit Safe Passage Project, and mentors a team of litigation associates in the firm’s New York office.

Abby’s interests include urban gardening, tending to gardens on fire escapes, rooftops and in tree wells. She lives in New York City with her family.
