Minimum Wage Increases on May 5th for Most in St. Louis

On May 5, 2017, the minimum wage in St. Louis will increase to $10.00 per hour for most employees.

All employers inside the geographic boundaries of the City of St. Louis must provide this notice of employee rights to all of their employees the next time that wages are paid. This payroll notice may be delivered electronically or on paper, as long as it is provided with each employee’s next paycheck. Employers must also post this notice in every workplace subject to the ordinance. The minimum wage will increase again on January 1, 2018, to $11.00 per hour.

Certain employers are exempt from this ordinance, including governmental entities (other than the City of St. Louis), sheltered workshops, any business whose annual gross revenue is less than $500,000 or if the business has been in operation for less than a year and whose annual gross revenue is reasonably projected to be less than $500,000, any employer who employs 15 or fewer employees regardless of location during each calendar week within the current and previous calendar year.

Employees entitled to the increased minimum wage are those who work at least 20 hours a year while physically present within the geographic boundaries of the City of St. Louis.

As you may remember, this minimum wage ordinance has a rather complicated history: The City adopted the Minimum Wage Law ordinance in 2015, but an injunction prevented it from going into effect at that time. The Supreme Court recently determined the ordinance is valid, which is why it is taking effect now.

Penalties for not compliance can include fines of $500.00 or less per violation (each day a violation exists is counted as a separate violation), payment of restitution and back wages (with interest), and revocation of the employer’s business license or permit.
