July 11, 2019  -  Messner Reeves’ Partners Katherine Otto and Haley Maglieri obtained a defense verdict on behalf of their client in Jefferson County District Court. The Plaintiffs claimed the Defendants breached their contract and acted negligently, causing structural damage requiring replacement of a commercial roof. Plaintiffs requested $717,000 in damages. After a four-day jury trial, the jury found in favor of Messner Reeves’ client.

LAS VEGAS, NV - June 14, 2019  -  Partners Caleb Meyer and Renee Finch successfully defended their client, a national automobile insurance company, after a five-day jury trial in Las Vegas, Nevada. The Plaintiff claimed the need for lumbar fusion surgery after a rear end accident and requested $781,000 in damages. The jury awarded $0 in damages and delivered a full defense verdict in favor of Messner Reeves’ client.

June 12, 2019  -  Messner Reeves’ Partners Doug Wolanske and Simone Montoya prevailed on behalf of their client, an Orthopedic Surgeon in Douglas County, CO. The Plaintiff’s counsel asked the jury to award between $1.5 and $2 million in damages. After a seven-day jury trial, the jury found no negligence and no causation in favor of Messner Reeves’ client.

Las Vegas, NV - May 2, 2019 - Plaintiff claimed bodily injuries exceeding $1.1 million stemming from a 2013 auto accident. Partners Caleb Meyer and Renee Finch defended the case, and after a six-day jury trial in Las Vegas, Nevada, the jury returned a defense verdict in favor of Messner Reeves’ client. 

March 11, 2019Doug Wolanske and Kate Bailey prevailed on behalf of a Glenwood Springs, Colorado hospital after a six-day medical negligence jury trial. Plaintiff’s counsel asked the jury to award $1.2 million in damages. The jury returned the defense verdict with less than an hour of deliberations. 

Partner Craig Humphrey and Associate Paul Sande prevailed with a favorable defense verdict in San Bernardino Superior Court of California following an eight-day jury trial. After being rear-ended at 20 miles per hour, the plaintiff had two spinal injuries that required fusion surgery. The plaintiff asked the jury for an award of past and future damages of nearly $1.9 million. The jury returned a verdict of $70,890, a mere 11.5% of the plaintiff’s requested damages.

Jury Delivers Complete Defense Verdict in Disability Discrimination Suit

On February 20, 2019, Messner Reeves Partners Charles Cavanagh and Kathleen Mowry prevailed with a complete defense verdict after the jury trial of an employment discrimination suit in a Los Angeles federal court. This is the fourth consecutive jury trial win in California for Charles Cavanagh, and the third in less than a year.

The plaintiff alleged the company wrongfully terminated her for taking a leave of absence after an unfortunate miscarriage. The company terminated the plaintiff after she failed to return to work following an approved leave of absence (that exceeded the minimum duration required by law). The plaintiff also refused to accept the company’s offer of reapplying and returning without any loss of seniority or benefits once she felt ready to return to work.

After less than 5 hours of deliberation, the jury delivered a complete defense verdict.

Last August, Cavanagh and Mowry prevailed in another California federal lawsuit concerning an age discrimination/failure to hire claim.

Last March, Cavanagh and Partner Amish Shah prevailed in a California state court jury trial of an employment action, including claims for harassment, disability, discrimination, and whistleblower retaliation.

Atwood in Las Vegas, NV obtained a complete defense verdict on behalf of a national automobile insurance company after a one-day jury trial in a rear-end personal injury case in which Plaintiff was seeking more than $40,000 in past damages, including $24,000 in past medical bills.

February 1, 2019 - Maia S. Smith in Rancho Cucamonga, California obtained a "Take Nothing" Defense verdict on a Workers' Compensation Trial after one day of testimony on behalf of a multi-tenant residential building owner.
